Killer of girl found in Dearborn Co. in 1991 denied appeal

Amber Garrett would be celebrating 43rd birthday Wednesday

(COLUMBUS, OH.) – The man accused of killing a girl in 1991 and leaving her body in Dearborn County has not been granted an appeal to have the case reopened. 


10-year-old Amber Garrett was abducted from Harrison and her body was found along Jamison Road after she had been missing for two days. 


Jeffrey Allen Wogenstahl was convicted of her murder and sentenced to death in Ohio. 


Wogenstahl is now 63-years-old and recently requested the Ohio Supreme Court to reopen an appeal. His claim was that the law subjecting him to trial in Ohio was unconstitutional in 1993.


His argument is that the trial should have been held in Indiana, due to that being where her death may have occurred.


On Tuesday, the Ohio high court rejected the claim and and an appeal will not be granted. 


The decision was made one day before Amber would have turned 43-years-old on October 2.
